Important: TideView is pre-release personal media server software. It does not sell or supply television channels, media files, third-party subscriptions, or permission to use content. You must provide authorized sources and the hardware, storage, accounts, and rights needed for your setup.
1. Agreement and eligibility
These Terms of Use are an agreement between you and TideView Media Technologies LLC ("TideView," "we," "us," or "our"). They apply when you visit our website, create a TideView account, purchase or redeem access, install TideView software, join a beta program, or use a TideView server or client (together, the "TideView Services"). By doing any of those things, you accept these terms and our Privacy Policy. If you do not agree, do not use the TideView Services.
You must be at least 18 years old or the age of legal majority where you live. A parent or legal guardian may authorize a minor to use a household profile and remains responsible for that use. If you act for a business or another person, you represent that you have authority to accept these terms for them.
2. Limited software license
Subject to these terms and an active TideView entitlement where required, TideView grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the TideView Services on supported devices you own or control for lawful, non-commercial household use. The software is licensed, not sold. TideView and its licensors retain all rights not expressly granted.
You may not redistribute, sell, rent, sublicense, host as a service for unrelated third parties, remove proprietary notices from, or use the TideView Services to build a competing product. Except where applicable law expressly permits it, you may not reverse engineer, decompile, defeat license or security controls, probe our systems without authorization, or modify the software for distribution.
Optional AI video enhancement may include NVIDIA Video Effects SDK software and Video Super Resolution models. Those components remain NVIDIA's and are supplied with their applicable licenses and notices when included in a TideView distribution. Use NVIDIA SDK components only on supported NVIDIA platforms, keep their proprietary notices, and do not imply NVIDIA sponsors or endorses TideView. Nothing in these terms limits rights expressly granted to you by an applicable third-party license.
3. Your server, media, and backups
You choose the folders, sources, tuners, devices, accounts, and users connected to your TideView server. You retain any rights you hold in your personal media and files. TideView does not acquire ownership of those files merely because the software catalogs, streams, records, converts, or backs them up on equipment you control.
You are responsible for your server, storage capacity, network, electrical power, security settings, backups, and recovery plan. TideView is not a backup guarantee. Keep independent copies of irreplaceable media, recordings, photos, videos, configuration, and encryption or vault credentials. Losing a password, drive, device, or encryption key may make data unrecoverable.
4. Authorized sources and acceptable use
You may use TideView only with content, signals, accounts, devices, guide data, and services you are authorized to access and use. You are responsible for determining whether recording, format shifting, remote viewing, sharing within a household, or any other use is lawful where you live and permitted by the applicable provider.
You may not use the TideView Services to infringe intellectual property or privacy rights; bypass digital rights management, conditional access, authentication, geographic restrictions, or other technical protections; restream or redistribute content without authorization; share paid provider credentials improperly; transmit malware or spam; harass others; impersonate another person; interfere with a network or service; evade limits; or engage in unlawful, fraudulent, deceptive, abusive, or harmful conduct.
5. Accounts, household users, and security
Google sign-in may be used to create and recover a TideView licensing account. Your entitlement is linked to the verified Google account you select. You are responsible for keeping that Google account secure, maintaining accurate contact information, and promptly notifying us of suspected unauthorized access. Signing in does not itself create paid or complimentary access.
The server owner controls household profiles, permissions, remote access, connected sources, and local retention. The server owner is responsible for people invited to use that server and for selecting age-appropriate content and access. You may not sell, publicly share, or transfer access to an unrelated person. A permitted computer replacement transfers the entitlement; it does not create an additional server license.
6. Early-supporter subscriptions, trials, and cancellation
TideView is preparing early access and no public app download is currently available. An early-supporter subscription supports ongoing development, testing, security work, test hardware, code-signing certificates, service licenses, infrastructure, and support. It creates a TideView server entitlement linked to your Google account for use when eligible software access is available. It is not an investment, ownership interest, charitable contribution, or promise of a particular public release date, feature, platform, or level of availability.
The early-supporter plan is $4 USD per month for one server, plus applicable taxes. Eligible new Google-linked accounts receive one seven-day free trial. A payment method is required. Before you confirm, Stripe Checkout displays the trial end date, price, renewal interval, and any amounts due. Unless you cancel before the trial ends, the plan automatically renews monthly at $4 plus applicable taxes until canceled.
You may cancel online through Manage subscription or TideView's Manage billing control. Cancellation stops future renewals and normally takes effect at the end of the current trial or paid billing period. Uninstalling TideView, releasing or turning off a server, deleting local data, or ceasing use does not cancel a subscription. Except where required by law or expressly stated at checkout, charges are non-refundable and we do not provide prorated refunds for a partially used billing period.
The $4 price remains attached to the same continuously maintained early-supporter subscription. Replacing a computer or recovering from a failed payment on that subscription does not change its price. If the subscription fully ends, a later subscription is subject to the price and terms then offered. Tester and complimentary codes provide only the access and duration stated with the code and do not create a paid subscription.
Stripe or another disclosed payment provider processes payment information and may act as merchant of record for a transaction. Its terms and privacy practices also apply. We do not receive your complete payment-card number. You authorize the payment provider to charge the payment method you select for the amounts disclosed at checkout.
7. License checks and offline operation
An activated server normally receives a signed offline allowance of up to 72 hours after a successful license check, capped by the end of paid, trial, or complimentary access. The server must reconnect to renew that allowance. A revoked entitlement, blocked installation, expired trial, canceled subscription, payment reversal, or unpaid account may lose access to TideView online services, and cached access ends when its signed allowance expires. Expiration does not authorize TideView to delete your personal media.
8. Pre-release software and updates
Alpha, beta, preview, and other pre-release versions are under active development. They may contain serious errors, lose settings, fail to record or play content, change without notice, or never become generally available. Features, interfaces, compatibility, system requirements, prices, release timing, and supported devices may change or be removed. Use pre-release software only with data and systems you can restore.
We may provide security fixes, upgrades, compatibility changes, and feature updates. Some updates may be required to continue using licensing, remote access, metadata, guide, or other online functions. Automatic updates depend on your settings and supported signed releases. You remain responsible for operating-system, driver, firmware, Roku, Android, tuner, and other third-party updates.
9. Third-party services and information
TideView may interoperate with payment processors, identity providers, app stores, metadata and guide providers, content sources, devices, operating systems, and other services not controlled by TideView. Their terms, fees, availability, regional limits, and privacy practices apply separately. We do not endorse or guarantee third-party services and are not responsible for their content, outages, changes, security, billing, or discontinuation.
Metadata, artwork, schedules, scores, channel information, and other third-party data may be incomplete, inaccurate, delayed, or unavailable. A listing, image, or link does not grant content rights or guarantee that a program is available from a source you are entitled to watch.
10. Support, diagnostics, and feedback
Support, installation assistance, feature requests, and response times are not guaranteed unless we expressly agree otherwise. If you choose to submit diagnostics or a support bundle, you authorize us to use it to investigate the issue, secure and improve TideView, and provide support as described in our Privacy Policy.
If you voluntarily send ideas or feedback, you grant TideView a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, modify, publish, and incorporate that feedback without restriction or compensation. This does not transfer ownership of your personal media.
11. Ownership and third-party marks
The TideView software, website, branding, original artwork, documentation, designs, and related technology are owned by TideView or its licensors and protected by intellectual-property laws. TideView is independent software and is not affiliated with or endorsed by Roku, Google, Microsoft, Stripe, Cloudflare, guide or metadata providers, content owners, leagues, channels, or device makers. Third-party names and marks belong to their respective owners.
12. Suspension and termination
We may limit, suspend, or terminate access on reasonable grounds, including nonpayment, fraud, a security threat, unlawful conduct, material breach of these terms, abuse of a beta program, or discontinuation of a TideView service. Where practical and lawful, we will provide notice and an opportunity to correct the issue. We may act immediately to protect users, TideView, third parties, or the integrity of our systems.
You may stop using TideView at any time. Ending use does not cancel recurring billing; use the online cancellation method in Section 6. On termination, the software license ends and you must stop using covered TideView software, but provisions concerning ownership, feedback, payments already due, disclaimers, liability, disputes, and other terms that by their nature should survive will remain in effect.
13. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TIDEVIEW SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TIDEVIEW DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, SECURITY, ACCURACY, AND COMPATIBILITY. WE DO NOT WARRANT THAT TIDEVIEW WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, FREE OF HARMFUL CODE, OR COMPATIBLE WITH EVERY DEVICE, SOURCE, CODEC, FILE, NETWORK, OR THIRD-PARTY SERVICE. RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED ARE NOT AFFECTED.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIDEVIEW AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OR CORRUPTION OF DATA, MEDIA, RECORDINGS, BACKUPS, PASSWORDS, OR SETTINGS; LOSS OF USE, REVENUE, PROFITS, GOODWILL, OR OPPORTUNITY; THIRD-PARTY FEES OR CLAIMS; OR DAMAGE CAUSED BY HARDWARE, NETWORKS, CONTENT, OR SERVICES OUTSIDE OUR CONTROL, EVEN IF ADVISED THAT SUCH DAMAGE IS POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF TIDEVIEW FOR ALL CLAIMS ARISING FROM OR RELATED TO THE TIDEVIEW SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID TO TIDEVIEW FOR THE TIDEVIEW SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT. Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply to you.
15. Your responsibility for claims
To the extent permitted by law, you agree to defend, indemnify, and hold harmless TideView and its members, employees, contractors, and service providers from third-party claims, damages, and reasonable costs arising from your unlawful use of TideView, your breach of these terms, or content and sources you configure that violate another person's rights. This obligation does not apply to the extent a claim results from TideView's own unlawful conduct.
16. Informal dispute resolution; Florida law
Before filing a lawsuit about these terms or the TideView Services, you and TideView agree to make a good-faith effort to resolve the dispute informally for at least 30 days. Send a written description of the issue, the relief requested, and contact information to support@tideview.tv. Either party may seek immediate relief for account security, intellectual-property misuse, or another urgent threat.
Florida law governs these terms, without regard to conflict-of-law principles, except where federal law or the mandatory law of your residence applies. Any court proceeding must be brought in a state or federal court of competent jurisdiction in Florida. To the extent permitted by law, each party waives trial by jury. Nothing in these terms prevents an individual from bringing an eligible claim in small-claims court.
17. Export and sanctions compliance
You may not use, export, re-export, or transfer the TideView Services in violation of United States export controls, sanctions, or other applicable trade laws. You represent that you are not prohibited from receiving the TideView Services under those laws.
18. Changes, notices, and general terms
We may update these terms as TideView develops. We will post the revised terms with a new effective date and provide additional notice when required by law. Changes apply prospectively. Your continued use after revised terms take effect constitutes acceptance where permitted by law.
Electronic notices sent to the email associated with your TideView account or posted through the TideView Services satisfy legal notice requirements where permitted. These terms and the Privacy Policy are the entire agreement about the TideView Services unless another written agreement expressly applies. You may not assign your rights under these terms without our consent; we may assign these terms as part of a financing, reorganization, merger, sale, or transfer of the TideView business. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. These terms do not create an employment, agency, partnership, or joint-venture relationship.
